ETHOS: ETHical Online diSput resolution Over the past decade, online dispute resolution (ODR) systems have experienced exponential growth, primarily developed to address consumer-to-business disputes in the e-commerce sector. The possibilities offered by ODR – such as cost efficiency, simplification, and convenience – have incentivized some jurisdictions to adopt judicial ODR. The COVID-19 pandemic further highlighted the need for ODR to improve access to justice. With its increasing use, the integration of AI in ODR systems has raised ethical concerns, particularly regarding accessibility, accountability, and fairness. Despite the diverse approaches to ODR, scholars emphasize the importance of revisiting ethical principles. This study combines doctrinal and empirical approaches to explore what constitutes an ethical ODR system in its design and implementation.
